Contacting the Board for legal interpretation

Post by dedkad »

This is a follow-up question as to whether or not a a plat is considered part of the legal description thus does not need its own stamp, or if it is considered a separate document and should be stamped in additon to the legal description. The responses in that thread appear to be split 50:50 so far, so it seems like an interpretation from the Board would be helpful. I have never contacted the Board before. I sent an email asking this question to the Enforcement email address. Will they respond to an email or do I need to write a letter? If letter, is there a specific person I should address the letter to? How long does it typically take them to respond?

You can email him, but you can also send him a letter with your question.

8761. Use of signature and seal
(d) All final maps, plats, reports, descriptions, or other land surveying documents issued by a licensed land surveyor or civil engineer authorized to practice land surveying shall bear the signature and seal or stamp of the licensee and the date of signing and sealing or stamping. If the land surveying document has multiple pages or sheets, the signature, seal or stamp, and date of signing and sealing or stamping shall appear, at a minimum, on the title sheet, cover sheet or page, or signature sheet, unless otherwise required by law.

Isn't your answer right here in the law? if you have one document, seems pretty black and white.

I think with plats and legals it depends on how one packages them. I label them 1 of 2 for the legal and 2 of 2 for the plat, and on the legal I state something to the effect of "The herein described parcel is shown on the attached map, Exhibit B, of this legal description, and is made a part hereof" so therefore I consider the seal on the plat to be unnecessary.

My stamp is not going to wear out any time soon, so I would probably lean towards stamping the attached/included map, whether legally required to or not. That way if the map is ever separated from the rest of the submittal package, there's no question as to its origin.

Mi dos pesos, anyway!

Thank you Ric and the Board for you prompt response. For those who are interested in the answer, please see the UPDATE posted here: http://clsaforum.californiasurveyors.or ... #post35814
The Board's interpretation is that it doesn't matter how it's packaged, legal descriptions and plats are considered separate documents and both require signature and seal.
