I had a situation..

I was called on to do a resurvey of a parcel that was just surveyed in February of this year.

After running in control to re establish the lot (it was a Parcel of a PM that was done by record, so I had to get all the controlling elements re established) I started locating the Feb set monuments and to my great surprise, I was missing them from 0.9' to 1.3'.

Not only that, but I was finding previous pipes just fractions of an inch away from my calc'd position. Two different RE tags.

I spoke to the client about contacting the other surveyor and filling them in that something was wrong. The client responded, as is so typical, with "I want your RS to get filed and then I will tell the other surveyor"

I don't like stuff like that.

So today I wrote the client an email and told him that if he refuses to allow me to contact the other surveyor then I would place a note on my RS as to why I was unable to contact the errant surveyor prior to the RS filing and that once the note is on the RS, it stays on the RS.

The client wrote back and said "if you want to speak to the other surveyor, go ahead and do so"

Sometimes you have to play the game the same way they want to play it to get it done right

Whose is the expert you or your client? The ethical and professional thing to do is to contact the the other surveyor. Your client has no authority to interfere with your search for evidence in the conduct of a survey on their behalf.

That was accomplished

He never did interfere.

Without getting into specifics, a possible lawsuit was on the table depending on the outcome of my survey. It turns out, that for now, the suit is on the back burner but you never know what a client will do in the future. This was the reason that he did not want me to contact the other surveyor in the beginning.
