Non Vehicular Access

Hello everybody.
I came across a Tract Map recorded in 1968 (County of San Bernardino) that created a subdivision of over 400 lots with several streets and alleys. The Map shows one of the main streets with a "non vehicular access" label. This street provides access to several single family residences. The County did not accept the alleys' right-of-way dedication.
My question to you is: what is the process to extinguish the "non vehicular access" restriction?

I recommend that you post a pdf of the map so we can see the owners statement language and the acceptance lanuage as well as the mapping. Thanks.

Which Road? Apple Valley?

If this is a HOA Subdivision, first you have to get them to OK a change. Then P&Z comes into play.

It has been that way for 40+ years. Chances of change ??

The process seems pretty clear in the SMA. See link:

While I just scanned those sections, this is the only pertinent section I saw and it is about as clear as a solid concrete wall about abolishing limited or non-access to a street:

"66476. There may be imposed by local ordinance a requirement that
dedications or offers of dedication of streets include a waiver of
direct access rights to any such street from any property shown on a
final or parcel map as abutting thereon and if the dedication is
accepted, any such waiver shall become effective in accordance with
its provisions."

I'd look to see what you can find on lots 166 and 165. they put in driveways to A.V.R. even though on the map it shows the non-vehicular access note.

The county didn't accept the alleys, but it looks like they built them anyways, did they accept them later or are the alley's private now?

does the document recored in book 6983 page 179 accept the alleys or remove the NVA restriction?
