4 parcels and remainder

I reviewed the thread entitled "5 parcel parcel map" This discussion did not answer the question I am about to ask.

Can an Owner create 4 parcels AND a reaminder parcel w/o triggering a "Subdivision" application ?

For some reason I thought section 66424.6 covered this pretty well.

BUTTTTTT here is my catch 22 . . . My client filed a 3 parcel / one remainder parcel a few years ago. Now he wants to split out a 4th parcel from his remainder.

Public agency is demanding a "Subdivision" application be filed.

Is the P.A. absolutely correct on this ?

IIRC Santa Barbra County got tired of subdivisions of 4 and a remainder on a PM then the developer coming back a year later and doing it again thereby circumventing the additional tract map fees and put a time limit on any subdivision of the remainder parcel.
