Scanning Services are NOT necessarily Surveying under LS Act 8726
At least thats what someone on RPLS.com told me the other day. I disagreed. The main question was posed by an unlicensed person who had a business model of buying his own scanner and subbing it out to surveyors.
Without a surveyor, could he assist police with it? Architects to do floor plans? Site Plans? PE's with a topo?
Are there loopholes in 6731 (PE Act) and by extension 8726 which would make
a business such as this legal?

Based on the information, I don"t see a problem.
The police are exempt.
Architecs use non-LS's to lacate steele in foundations. You get what you pay for.
Site Plan and Topo typically will need a stamp.
HDS has taken off and is being used in many industies by non-LS's.
If no one wants an accuracy statement of his work then he can do what he wants to. He needs to stay away from Boundaries.
GIS folks have been locating fixed public works for years now and still are.

I saw that thread. The guy is about to graduate with a geomatics degree and thinks he has it all over all us jurassic period surveyors who are still working with solar transits and gunter's chains. He is proposing locating fixed works on a project site and then selling the data to surveyors and engineers. If he does it the way many photogrammatrists run their businesses, where the LS provides control before the flight and QC afterward, he may be OK.
If he is just collecting data and providing point clouds, independent of the LS, he is violating 8726. It seems like this is the way he intends to go.
Police have a special exemption in the law for what they do. That's not a good comparison. The architect's example is one where carpenters can make the measurements as they are only locating one element of a building foundation in relationship to the overall foundation.

I didn't read every post in detail, but wasn't he given that advice several times? Looked to me like he has his mind made up. He has his techy toy, if he can afford it, his fancy new degree with all the latest and greatest knowledge that the rest of us somehow missed, and he's going to take the mapping world by storm!
