I have a tentative tract map that has already completed the entitlement phase and is approved... There are 5 existing lots that are all tied that make up the property of the tentative map, the tentative tract map has 12 lots. What I am wondering:
One proposed new lot is entirely inside of existing Lot 'A' at the map boundary, bordering on a public ROW. What I'd like to do, is to create this new lot, call it Lot '1', first, which is essentially a corner piece of Lot A (Lot 1 is one of the proposed lots shown on the tentative map). After changes in the project master plan, I'd like to get this new lot 1 created first (possibly by subdividing Lot A through a parcel map?) while keeping the remainder of the ongoing tentative map active (longer term development for the remainder of the property). Essentially I'd like to phase this one lot in before 'creating' the rest of those lots shown on the tentative map. And no, this TM was not initially setup in phases. Does anyone have any inference on what the map act says about something like this? I'm still looking, but thought I'd throw the question out there for some help. Thinking possibly a Parcel Map dividing Lot A into Lot 1 and remainder, but not sure if that'd be allowed since Lot 1 is already part of the approved TTM. Kind of a mess!

so far SMA 66456.1 is the best answer I've been able to come up:

66456.1. Multiple Final Maps May be Filed from One Tentative Map

Multiple final maps relating to an approved or conditionally approved tentative map may be filed prior to the expiration of the tentative map if: (a) the subdivider, at the time the tentative map is filed, informs the advisory agency of the local agency of the subdivider’s intention to file multiple final maps on such tentative map, or (b) after filing of the tentative map, the local agency and the subdivider concur in the filing of multiple final maps. In providing such notice, the subdivider shall not be required to define the number or configuration of the proposed multiple final maps. The filing of a final map on a portion of an approved or conditionally approved tentative map shall not invalidate any part of such tentative map. The right of the subdivider to file multiple final maps shall not limit the authority of the local agency to impose reasonable conditions relating to the filing of multiple final maps.

I had a similar situation a couple of years ago, although I had an approved tentative map for 4 parcels. The client wanted to be able to sell one of the lots to finance the development of the other 3. I had to submit a new tentative map showing the “phased” development and basically go through a review of the entire approved tentative map (and pay the fees for a new submittal). The down side in this process to get the phased development is the local agency gets another bite of the apple, so to speak. The project is reviewed like a new submittal and may be subject to new conditions that weren’t includedi n the original approval. That, to me, is the chance you take.

In my case the client had make some initial infrastructure improvements to develop and sell the first lot that weren’t included in the first approval.
