I'd be interested hearing different views on the legality of hydrographic surveyors practicing without a land surveyor's license. Hydrographic surveying typically involves mapping the bottom of water bodies, and frequently involves shoreline (and further landward) mapping as well as tying into geodetic control.

Your thoughts?

I can't find any licensing exemption for hydrographic surveying. The bottom of water bodies is ground, and therefore the surface of the earth.

Hydrographic surveying is surveying, and depending upon the particulars of the project, and subject to any licensing exemptions enumerated under §8730, it would need to be performed under the direction and control of a RCE and/or a PLS.

I know of at least one situation where an out-of-state company came in to California to do work with side-scan sonar. I'm pretty survey they didn't have a licensed land surveyor in charge, at least not one licensed in California. I can't remember the name of the company now.

I agree with Evan. I think hydrographic surveying is included in the practice of land surveying defined by California law.

Why are you asking the question? I do not know anyone that does not think hydrographic surveying is covered by the PLS act.

It's an unlicensed practice matter. I just wanted to get a sense of whether or not the hydro guys have been getting a bye on the license thing. I recall a deputy AG some years back advising BPELS not to go after one because it would open a big can of worms.
