Who may write Land Descriptions?

I am a Volunteer for a LS Review Class that we (CLSA â€“ San Diego Chapter) are hosting. The question â€œWho may write Land Descriptionsâ€ came up in our Legal Descriptions class. I have attached a 2004 LS Review Class reference that I have by Roy Minnick â€“ Laws for the California Surveyor. It was also mentioned in our LS Review class that Utility Companies might also be except from the â€œonly Land Surveyors may write Land Descriptionsâ€.

If anyone has a more recent reference or some information on this topic to share, it would be greatly appreciated.

See Â§8730 of the Business and Professions Code, which deals with exemptions from licensure. It spells out the utility company exception with regard to description writing.

Â§8730 (c) (2) contains language requiring a Licensed Land Surveyor to be on staff or under contract with utility agencies - but does not specifically say this person needs to seal the legal descriptions.

Since it's an exemption from the licensure requirement, no sig/seal is necessary when the big utilities write descriptions.

Thank You /Muchas Gracias for all your contributions. Hopefully someday we (Land Surveyors) will gain more respect on this (and other) land surveying topics and state law will require Land Surveyor (only) to sign and stamp all Land (Legal) Descriptions.

Big business/utility cos write the laws - the politicians are just their puppets.

Couple of years ago I ran across one of the worst descriptions ever. "Crafted" by some guy working for a gas company. Besides not accomplishing what he intended, and wasting a client's money, it's an extreme affront to those of us who've labored so hard to do it right.

Ya - but they need to be retraceable. Not an "Exhibit A" being an attached APN map with a line drawn on it saying "Utility Easement". This is not retraceable as far as I'm concerned. Just saying…
